1. Acceptance of Terms

By accessing or using MockMate ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and MockMate.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

2. Description of Service

MockMate is an independent educational technology platform that provides AI-assisted practice exams, question banks, and study tools. The Service includes custom mock exams generated from user-uploaded materials, standardized test practice (including SAT-style practice), AI-generated performance feedback, and study analytics.

MockMate is a practice and preparation tool only. It does not administer official exams, award official scores, or guarantee outcomes on any standardized test.

3. No Affiliation with College Board

MockMate is not affiliated with, endorsed by, sponsored by, or in any way officially connected to College Board®. SAT® is a registered trademark of College Board. Our SAT-style practice content is independently created for educational purposes only and does not reproduce any official College Board materials.

Practice scores generated by MockMate are estimates only and are not official SAT scores. Official scores can only be obtained by taking the SAT through College Board.

4. Eligibility and Account Registration

You must be at least 13 years old to use MockMate. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service and agree to these Terms on your behalf.

You agree to provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

5. Use of Artificial Intelligence

MockMate uses AI technology to generate practice questions, provide performance feedback, and offer study recommendations. AI-generated content may be incomplete, inaccurate, or outdated. You should use AI feedback as one of many study aids and not as the sole basis for your preparation.

By using features that generate AI responses, you consent to your exam performance data being processed to produce that feedback. See our AI Disclosure for full details.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Reproduce, distribute, or resell any content from MockMate without written permission
  • Attempt to reverse-engineer, decompile, or access source code of the Service
  • Use the Service to cheat, gain unfair advantage, or commit academic dishonesty
  • Upload content that is illegal, harmful, or infringes third-party rights
  • Interfere with the security, integrity, or availability of the Service
  • Share your account credentials with others or allow unauthorized account access

7. Intellectual Property

All content on MockMate — including but not limited to practice questions, explanations, software, design, logos, and text — is owned by MockMate or its licensors and is protected by copyright and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial educational purposes only.

8. User-Uploaded Content

When you upload materials (such as notes, syllabi, or past exams) to generate a custom mock exam, you grant MockMate a limited license to process that content solely to provide the requested Service. You represent that you have the right to upload such materials and that doing so does not violate any third-party rights.

MockMate does not claim ownership over your uploaded content. You remain responsible for any content you upload.

9. Payments and Subscriptions

Some features of MockMate may require a paid subscription. By subscribing, you agree to pay all applicable fees. Subscriptions automatically renew unless cancelled before the renewal date. See our Refund Policy for information about cancellations and refunds.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. MOCKMATE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS OBTAINED FROM USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.

MockMate does not guarantee any improvement in test scores, academic performance, or outcomes as a result of using the Service.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MOCKMATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF MOCKMATE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL MOCKMATE'S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO MOCKMATE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless MockMate and its officers, directors, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

13. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

14. Third-Party Services

MockMate may integrate with or link to third-party services (such as payment processors, AI providers, or analytics platforms). Your use of such third-party services is governed by their respective terms and privacy policies. MockMate is not responsible for the practices of any third-party services.

15. Termination

MockMate reserves the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our discretion. Upon termination, your right to access the Service ceases immediately.

16. Modifications to the Service

MockMate reserves the right to modify, suspend, or discontinue any part of the Service at any time without notice or liability. We may add or remove features, change pricing, or limit access to certain parts of the Service.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that you may bring claims in small claims court if they qualify.

You waive any right to participate in a class action lawsuit or class-wide arbitration related to the Service.
